Government Regulation for Forest Rental/PP Penyewaan Hutan

This country –Indonesia- which got many hits from natural disasters could not make their leaders got some enlightenment. Although they already warn by many sides, including their own care peoples and international bodies, natural protection is not their priority still.  Just look at Government Regulation No. 2/2008 issued, which is claimed by the President as continuation of Government Regulation as State Law Replacement No.1/2004, then acclaimed as State Law No. 19/20004, as a revision from State Law No. 41/1999 about Forestry. This Government Regulation already raised protest action from peoples represented by pro-environment NGO. Afterwards, many peoples participated to save Indonesian forests with donated their money to rent forest for save them. Those new Government Regulation gave opportunity for everybody to rent forest and convert it into mining, especially for industrial companies.
    
This is ironic, this issued of Government Regulation had showed to us that Indonesian government not thinking widely. Even Forestry Minister who have obligation to protect our forest made a statement that Government Regulation not separated from President Declaration No. 41/2004 which issued by Megawati. This Presidential Regulation which became foundation for 13 mining company to operate within protected forest. Meanwhile, besides wrong according to state ordinance law (Government Regulation is higher then Presidential Regulation), it is a necessary for recent government to cancel those Presidential Regulation because it can implied to environment mass destruction. This act frankly contrast with Habibie’s policy with State Law No. 41/1999 with stated banning for open mining within protectorate forest area. 

The dumb me became confuse, what in the decision maker mind actually beside money, huh? Is it time to change our first of Five Pillars (as Republic of Indonesia highest principle, originally “Believe in One God”.) into “Believe in Money Which The Most Powerful”?

Negeri yang sudah berkali-kali gemetar oleh bencana alam ini tampaknya tidak membuat para pemimpinnya kapok. Meski telah diingatkan berbagai pihak, mulai dari masyarakat hingga badan-badan internasional, perlindungan terhadap alam masih belum diprioritaskan.  Coba saja lihat penerbitan PP No. 2/2008 yang diklaim Presiden sebagai kelanjutan Perpu No.1/2004, yang lalu ditetapkan lewat UU No.19/2004, sebagai revisi dari UU No.41/1999 tentang Kehutanan. PP ini telah memicu aksi protes dari kalangan masyarakat yang diwakili LSM pro-lingkungan. Bahkan berbagai kalangan ikut peduli dengan menyumbangkan donasinya guna menyewa hutan untuk dilestarikan. Kita tahu, PP tersebut memberi kesempatan pada siapa saja terutama perusahaan industrialis untuk menyewa hutan guna dijadikan tambang. 

Ini sangat ironis, dimana pemerintah berpikir hanya dalam jangka pendek. Bahkan Menteri Kehutanan yang semestinya melindungi hutan malah mengatakan PP tersebut tidak terlepas dari Keppres No.41/2004 yang diterbitkan Megawati. Keprres ini menjadi dasar bagi 13 perusahaan tambang untuk beroperasi di kawasan hutan lindung. Padahal, selain salah menurut hukum tata negara (PP lebih tinggi dari Keppres), malah sudah seharusnya Keppres itu dicabut karena jelas merusak lingkungan. Padahal, Habibie pernah menerbitkan UU No.41/1999 yang di dalamnya justru menegaskan pelarangan pertambangan terbuka di hutan lindung. 

Saya yang bodoh ini menjadi bingung, sebenarnya apa yang ada di otak pembuat keputusan negara itu selain uang ya? Apakah sudah seharusnya sila pertama Pancasila kita ganti “Keuangan Yang Maha Kuasa”?

  1. Ada bagusnya para aktivis lingkungan dan orang-orang seperti anda yang peduli lingkungan yang menjadi pejabat di negara ini. Jangan seperti kami-kami yang cuma paham birokrasi.
